 "text": "RS 14:71.1\n\n\u00a771.1. Bank fraud\n\nA. Whoever knowingly executes, or attempts to execute, a scheme or artifice to do\nany of the following shall be imprisoned, with or without hard labor, for not more than ten\nyears, or may be fined not more than one hundred thousand dollars, or both:\n\n(1) To defraud a financial institution.\n\n(2) To obtain any of the monies, funds, credits, assets, securities, or other property\nowned by or under the custody or control of a financial institution by means of false or\nfraudulent pretenses, practices, transactions, representations, or promises.\n\nB. Upon a second or subsequent conviction of a violation of the provisions of this\nSection, the offender shall be imprisoned, with or without hard labor, for not less than one\nyear nor more than ten years and may, in addition, be required to pay a fine of not more than\none hundred thousand dollars.\n\nC. In addition to the penalties provided in Subsection A of this Section, a person\nconvicted under the provisions of this Section shall be ordered to make full restitution to the\nvictim and any other person who has suffered a financial loss as a result of the offense in\naccordance with Code of Criminal Procedure Article 883.2.\n\nD. As used in this Section, the term \"financial institution\" means any federally\ninsured depository institution chartered under the laws of the United States, this state, or any\nother state.\n\nActs 1992, No. 104, \u00a71, eff.
