 "text": "RS 14:70.8\n\n\u00a770.8. Illegal transmission of monetary funds\n\nA. Whoever with intent to defraud either transmits, attempts to transmit, causes to\nbe transmitted, solicits a transmission, or receives a transmission, by wire or radio signal, any\nstolen or fraudulently obtained monetary funds shall be imprisoned, with or without hard\nlabor, for not more than ten years, or fined not more than one hundred thousand dollars, or\nboth.\n\nB. Upon a second or subsequent conviction of a violation of the provisions of this\nSection, the offender shall be imprisoned, with or without hard labor, for not less than one\nyear nor more than ten years and may, in addition, be required to pay a fine of not more than\none hundred thousand dollars.\n\nC. In addition to the penalties provided for in Subsections A and B of this Section,\na person convicted under the provisions of this Section shall be ordered to make full\nrestitution to the victim and to any other person who has suffered a financial loss as a result\nof the offense in accordance with Code of Criminal Procedure Article 883.2.\n\nD. For purposes of this Section:\n\n(1) \"Radio signal\" means any text, email, or any other wireless transmission from\ncellular phones, portable wireless electronic tablets or computers, or any other wireless\ndevice used to transmit or receive monetary transactions.\n\n(2) \"Wire\" means any wired electronic device that provides access to the internet or\nto any other access point and allows monetary transactions to be transmitted or received by\nemail, financial institution-to-financial institution transfer, or money transfer facility.\n\nActs 2012, No. 540, \u00a71, eff.
