 "text": "RS 14:41.1\n\n\u00a741.1. Consent; victim in police custody\n\nFor purposes of this Subpart, a person is deemed incapable of consent when the\nperson is under arrest or otherwise in the actual custody of a police officer or other law\nenforcement official and the offender is a police officer or other law enforcement official\nwho either:\n\n(1) Arrested the person or was responsible for maintaining the person in actual\ncustody.\n\n(2) Knows or reasonably should know that the person is under arrest or otherwise in\nactual custody.\n\nActs 2018, No. 407, \u00a71, eff.
